- This article will examine the right of the child to be heard in the context of the rights of children living in alternative forms of care (specifically foster care) to participate in care placement decision-making. Decisions relating to foster care placement can have a significant and long-lasting impact on the child in question. The discussion will begin by examining the general rights of children living in alternative forms of care under the UN Convention on the Rights of the Child. It will then address the State’s obligations under Article 12 CRC in relation to ensuring the right of the child to participate in all judicial and administrative decisions, with a focus on decision-making in respect of foster care placements.
