- In March 2010, the HK government published a consultation paper to propose statutory codification of certain requirements to disclose price sensitive information by listed corporations as the first step of giving statutory backing to the Listing Rules. This article compares the legislative proposals in Hong Kong with Australia’s continuous disclosure regime under Ch 6CA of its Corporations Act, and seeks to identify what the former can learn from the latter’s model in implementing a statutorily-backed listing rules. It is argued that Hong Kong should follow an evolutionary approach by first giving statutory backing to basic continuous disclosure obligations.
