- Description
- The separate civil action for breach of statutory duty has a long history and may provide enforcement of rights not found in other tort actions. It continues as a distinct tort action. In its traditional form the action is clearly based on the will of the democratically elected Parliament, and is not presented solely as a question of "reasonable care," unless Parliament has chosen to use that standard. Hence it is not appropriate to regard it as merely a part of the law of negligence.
